Usually you have to sign a contract because the cell phone company is subsidising the cost of your phone. A phone may be $300 if you buy it outright but if you sign a contract it is free. Having the contract and the early termination fees ensures that the company will recoup what it put out to get you as a customer.
I remember when cell phones were in the hundreds to near $1000 dollars. It was cost prohibitive for most people to own a phone.
